Mandate

To play a vital role through employment related activities to build a productive workforce and to lend support to all efforts to enable the people of Seychelles to become self sufficient, enjoy decent work that leads to rewarding and enhanced quality of life.

Roles and functions of the Secretariat

The Principal Secretary is the Chief Executive and Accounting Officer of the Department of Employment. The role of the Principal Secretary is to direct and coordinate the general functioning of the Organization within the operational guidelines of government policies and ensure effective deliverance of its mandate, under the direction of the Minister.   

The main responsibilities of the Principal Secretary are:
 

  • The overall management of the staff and budget.
  • The formulation and implementation of employment laws and policies.
  • To coordinate the enforcement of labour legislation and propose amendments as and when required.
  • To ensure that the international obligations of Seychelles under the preview of the Department are fulfil.
     

The Department's strategic plan, formulated for 5 years, is the document that guides the work of the different sections.  From there, an action plan which outlines the specific activities to be undertaken by the different Divisions, Sections and Units is prepared for each consecutive year.

The Ministry works in close collaboration with workers’ and employers’ organizations where they are consulted on employment and other industrial relations issues.

We are also partners, in regional and international particular the ILO, an organization that promotes rights at work and encourages decent employment opportunities amongst others, with whom the Government has signed the Seychelles Decent Work Country Programme.

The Committee on Employment of Non-Seychellois (CENS) was set up to advise the Ministry of Employment, and Social Affairs on issues relating to the employment of Non-Seychellois. It also assists in monitoring and coordinating the employment of non-Seychellois workers in the country.

The Committee can achieve this by;
 

  • Reviewing/proposing new strategies for effective management of non-Seychellois workers based on performance of the local labour market;
  • Reporting and making recommendations on the employment of non-Seychellois
  • Assisting with the monitoring and evaluating of the Localization Plan

 

The Committee meets every two months and consists of representatives from the following Ministries and organizations:
 

  • Ministry of Employment, and Social Affairs
  • Ministry of Tourism and Culture
  • Ministry of Finance Trade and Investment
  • Ministry of Health
  • Immigration Division
  • Seychelles Chamber of Commerce and Industry (SCCI)
  • Association of Seychelles Employers (ASE) and
  • Seychelles Federation of Workers’ Union (SFWU)
  • All posts shall be advertised as per section 9 (4) or 11 of the Employment Act 1995.
  • The adverts shall be done prominently, clearly indicating the job requirements, required qualifications, basic terms and conditions including salary and other benefits, as per section 11 (1) of the Employment Act.
  • All written adverts shall run for at least three consecutive days in a local daily newspaper.
  • The application for Employment of non-Seychellois may be submitted to the Ministry of Employment, and Social Affairs 14 days after the first appearance of the advert.

Inspection Officers from the Labour Monitoring and Compliance Section have the following powers as per the Occupational Safety and Health Decree, Chapter 151;

a) Enter at any reasonable time (or at any time in a dangerous situation) any premises which he/she has reason to believe it is necessary for him to enter,

 

b) Call for and obtain the assistance of a police officer if he/she apprehends any resistance to the exercise of his/her powers.

 

c) Take with him any other person duly authorized by the Minister, and any equipment or materials.

 

d) Make such examination and investigation as may be necessary.

 

e) Take such samples, measurements and photographs and make such recordings as he may consider necessary.

 

f) Require any person who he has reasonable cause to believe to be able to give any information relevant to any examination or investigation under paragraph (d) to answer such questions as the officer sees fit to ask.
