Committee on Employment of Non-Seychellois

The Committee on Employment of Non-Seychellois (CENS) was set up to advise the Ministry of Labour and Human Resource Development on issues relating to the employment of Non-Seychellois. It also assists in monitoring and coordinating the employment of non-Seychellois workers in the country.

The Committee can achieve this by;
 

  • Reviewing/proposing new strategies for effective management of non-Seychellois workers based on performance of the local labour market;
  • Reporting and making recommendations on the employment of non-Seychellois
  • Assisting with the monitoring and evaluating of the Localization Plan

 

The Committee meets every two months and consists of representatives from the following Ministries and organizations:
 

  • Ministry of Labour and Human Resource Development
  • Ministry of Tourism and Culture
  • Ministry of Finance Trade and Investment
  • Ministry of Health
  • Immigration Division
  • Seychelles Chamber of Commerce and Industry (SCCI)
  • Association of Seychelles Employers (ASE) and
  • Seychelles Federation of Workers’ Union (SFWU)

Guideline for Publication of Adverts for employment of Non-Seychellois

  • All posts shall be advertised as per section 9 (4) or 11 of the Employment Act 1995.
  • The adverts shall be done prominently, clearly indicating the job requirements, required qualifications, basic terms and conditions including salary and other benefits, as per section 11 (1) of the Employment Act.
  • All written adverts shall run for at least three consecutive days in a local daily newspaper.
  • The application for Employment of non-Seychellois may be submitted to the Ministry of Labour and Human Resource Development 14 days after the first appearance of the advert.

Procedure for Non-Seychellois Workers

1. The Employer makes the application on form provided by the Ministry of Labour and Human Resource Development submitting the following documents as applicable:

 

  • Proof of vacancy adverts in a local newspaper or from a Private Employment Agency. LINK.
  • Copy of company’s License
  • Company’s Establishment List
  • List of respondents to the advert
  • Company’s Certificate of Incorporation
  • List of approved projects and their duration (where applicable)
  • Accommodation Certificate from Ministry of Health
  • Localization/Succession plan and/or training plan (where applicable)
  • Copy of previous GOP in case of renewal
  • Marriage Certificate if married to a Citizen of Seychelles
  • CV of prospective post-holder, if already known
  • Evidence of salary payment (where applicable)
     

NB: Application Forms will not be processed if any of the above documents are not attached. In case of renewals, the application should be made no later than 2 months before the GOP expires.
 

Note: Procedures to advertise vacancies for the following will not apply : 
 

  • Short-term applications below 6 months
  • Director/Shareholder of companies

 

2. The application should be submitted to the Labour Migration Section of the Ministry, at Oliaji Trade Centre, State House Avenue, Room 4, 2nd Floor in due time for processing

 

3. The minimum time for the processing of the application will be 3 working days and maximum 9 working days.

 

4. If there is a need for further investigation to ascertain the information submitted by the Employer, the case may be delayed but should not take more than 3 working days.

 

5. If the application is approved, the Ministry will provide the Employer with a certificate confirming that there is no Seychellois available at present time to take up the post.

 

6. Once approval has been given by the Ministry, the Employer will be required to present the certificate to the Immigration Division when applying for a Gainful Occupation Permit for the Non-Seychellois. 

 

7. Appeal Process: Where an Employer is not satisfied with a decision, the Employer may appeal in writing to the Minister for Labour and Human Resource Development. The appeal should be handled within a period of 7 working days from the date of the decision. An Employer who fails to appeal within the specified time frame loses the right of appeal. All cases of appeal have to be approved by the Minister for Labour and Human Resource Development.

 

Note: Employers are advised that the timeframe to submit another application once the appeal process is over is 6 months and above.

 

Duration of Appeal Process: minimum 4 working days, maximum 5 working days.

3. What are the relevant documents you should attach with the application form?

 

  • Proof of vacancy advert (link to guidelines for publication of advert)
  • List of respondents to the advert
  • Updated Establishment List with all information as required on the form
  • CV of prospective post-holder, if already known
  • Business License issued by Seychelles Licensing Authority, where applicable(link with SLA website)
  • Copy of Gainful Occupation Permit (G.O.P) in the case of renewal
  • Marriage Certificate if married to a Citizen of Seychelles
