HOW DO I CALCULATE COMPENSATION FOR LENGTH OF SERVICE ?

Salary × 12 × number of hours worked per day × number of days entitled (5/6 of a day’s wage for each month completed) ÷52 ÷ number of hours worked per week (Section 24 (20 of S.I 34 of 1991) and (S.I 46 of 2010)

WHAT IS THE FORMULA FOR CONVERTING ANNUAL LEAVE INTO CASH?

Salary per year × number of leave to be converted ÷ number of days per year (Regulation 9 (8) (a) of S.I 3 of 2000).

WHAT IS THE PERIOD OF NOTICE FOR TERMINATION OF EMPLOYMENT?

  • in the case of a casual worker - One day notice (Section 60 (1) (a) of EA 1995)
  • in the case of a worker on probation - Seven days notice ( Section 60 (1) (b) of EA 1995)
  • in the case of any other worker - One month notice  (Section 60 (1)  (c) of EA 1995)
  • in the case of a non- Seychellois worker - The period of notice specified in the contract, or where a period of notice is not specified, with one month notice(Section 60 (1) (d) of EA 1995)

WHAT IS THE NATIONAL MINIMUM WAGE FOR A WORKER ?

  • under a contract of continuous employment - SR 19.80 for every hour of service ( S.I 90 of 2008)
  • under a contract of fixed-term employment - SR 19.80 for every hour of service (S.I 45 of 2010)
  • for a part-time worker - SR 19.80 for every hour of service (S.I 45  of 2010)
  • for a casual worker - SR 22.80 for every hour of service  (S.I 45of 2010)

WHAT IS A CASUAL CONTRACT OF EMPLOYMENT?

A person working by the day and paid on a daily basis and whose work does not exceed 3 months.
