All applications are to be done according to a prescribed
form, obtainable at the Employment Department or on the Ministry’s official web
site. Forms are also to be made available in all district administration offices.
The
unit ensures that all posts being applied for employment of non-Seychellois have
been advertised in accordance with section 9 (4)and/or 11 of the Employment Act
1995.
In case the post was not advertised the applicant is asked
to do so before any further consideration can be given to the application. On receipt
of the completed application form and proof of advert, the unit verifies the job
seekers database to ascertain the availability of local job seekers. In case that
a local job seeker is available the person is contacted and referred to the employer
organization for consideration. If the local job seeker is not selected for employment,
the unit conducts site visit if (necessary) to satisfy itself that the request is
genuine and necessary.
Depending on the findings at (6), the officer recommends
the approval or non-approval of the application on file with the following therein
enclosed
The letter of request accompanied by proof of advert.
The
proof that local job seekers are not available.
The
establishment list of the employer organization.
Proof
that there are no arrears in payment of attestation fees by the applicant.
Justification for the recommendation.
The approval or non-approval of the ministry is conveyed
to the applicant by letter. If approved the applicant is advised to contact
Immigration for the processing of the Gainful Occupation
Permit (GOP) and to have the contracts attested once permit is issued by Immigration.
The contract of employment is received, verified and attested if the officer is
satisfied that it complies with the Employment Act 1995.
The fee amounting to SR
500 per person must accompany the submission of contracts for attestation.
Data
on the number of approved cases are fed to the Planning, Research and Information
Section for the databases.
